SMS Messaging Terms & Consent

1. Program Description
BrandAmplifi sends SMS text messages on behalf of businesses using our platform. Messages include:
- Review requests — invitations to leave a review for a business you visited or received service from
- Survey invitations — requests to complete a customer feedback survey
- Survey follow-ups — multi-step conversational survey questions via SMS
- Appointment reminders — notifications about upcoming appointments or services
- Service notifications — updates related to a business interaction you had
1a. BrandAmplifi Platform Account Messaging
Separately from messages sent on behalf of our business clients, BrandAmplifi LLC sends a limited set of transactional and account-related SMS messages directly to our own platform account holders (people who sign up at brandamplifi.com). These are not marketing messages and are not sent on behalf of any other business. Account messages include:
- Password reset codes and two-factor authentication (2FA) codes
- Trial-ending and billing reminders for your BrandAmplifi subscription
- Login security alerts (for example, a new sign-in to your account from an unrecognized location)
- Support ticket notifications when a BrandAmplifi support agent replies to a ticket you opened
You opt in to these account messages at brandamplifi.com/signup or in your Notification Settings by checking “I agree to receive SMS from BrandAmplifi about my account.” Your IP address and timestamp are recorded with your consent. Message frequency is up to 4 messages per month per account. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time. Opt-out is processed immediately by our inbound SMS webhook and you will receive a one-time confirmation. BrandAmplifi does not sell, rent, or share your mobile number with third parties for their marketing or promotional purposes.
2. How Consent Is Collected
We obtain consent to send SMS messages through the following methods:
- Direct opt-in by the business customer: When you provide your phone number to a business that uses BrandAmplifi (for example, on a patient intake form, service agreement, customer registration, or point-of-sale interaction), the business collects your consent to receive follow-up messages including review requests and surveys.
- Contact import with opt-in verification: Businesses import their customer contact lists into BrandAmplifi. Each contact record includes an SMS opt-in field that must be set to “true” before any messages can be sent. Our system enforces opt-in status checks before every message delivery.
- In-app consent checkboxes: When a business user sends review requests or survey invitations through our platform, the sending interface requires confirmation that recipients have provided consent to receive text messages.
- Kiosk and tablet opt-in: At in-location kiosks and tablets, customers enter their phone number and explicitly agree to receive a follow-up text message before submission.
3. Opt-In Enforcement
BrandAmplifi enforces opt-in at multiple levels:
- Each contact in our database has an
smsOptInfield that must betruebefore any SMS can be sent - Our opt-in guard system automatically blocks message delivery to contacts who have not opted in
- Opt-in source and timestamp are recorded for every contact (e.g., “website”, “import”, “kiosk”, “pms_integration”)
- Businesses cannot bypass opt-in checks — they are enforced at the API level
4. Message Frequency
Message frequency varies by use case. Typically, a recipient will receive 1-3 messages per business interaction (for example, one review request after a visit, or 2-3 messages for a multi-step survey). Recipients will not receive more than 5 messages per month from a single business using our platform.
5. Message and Data Rates
Message and data rates may apply. Check with your wireless carrier for details about your messaging plan.
6. How to Opt Out
You can opt out of receiving SMS messages at any time by replying STOP, UNSUBSCRIBE, END, QUIT, CANCEL, or OPTOUT to any message you receive from us. You will receive a one-time confirmation message and no further messages will be sent. To re-subscribe, reply START, SUBSCRIBE, UNSTOP, or RESUME. You may also contact the business directly or email us at [email protected] to request removal.
7. Help
For help, reply HELP or INFO to any message, or contact us at [email protected]. The HELP response will include the brand name, contact information, and a reminder of how to opt out.
7a. Carrier Non-Liability
Carriers (AT&T, Verizon, T-Mobile, Sprint, US Cellular, MetroPCS, Boost, and others) are not liable for delayed or undelivered messages. Message delivery is subject to carrier capabilities, carrier coverage, and your wireless plan. BrandAmplifi is not responsible for any wireless carrier charges incurred from receiving these messages.
8. Privacy
Your phone number and messaging data are handled in accordance with our Privacy Policy. We do not sell, rent, or share your phone number with third parties for marketing purposes. Phone numbers are stored securely and used only for the purposes described in this policy.
9. Supported Carriers
Messages are delivered via major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier support may vary.
10. Opt-In Notice & Consent
The following supplemental opt-in notice expands on Section 2 (How Consent Is Collected) and is reproduced here verbatim for compliance review.
How We Collect Consent
BrandAmplifi sends SMS messages on behalf of businesses that use our platform. Before any SMS messages are sent, the recipient must have provided their phone number and explicitly consented to receive text messages from their service provider via BrandAmplifi.
Consent is collected in the following ways:
- In-person registration: Customer provides their phone number on an intake or registration form at their service provider's office. The form includes the following consent language near the phone number field.
- Online registration: Customer enters their phone number during online account creation or check-in, with the same consent disclosure.
- Kiosk/tablet opt-in: Customer enters their phone number on a kiosk or tablet device at the service provider's location and agrees before submission.
Example Opt-In Form
This is a representation of the opt-in form shown to customers during registration.
The customer must explicitly check the box above before the form will submit. The button below is disabled until consent is given. No pre-selection, no bundled consent, and no implied-consent language (e.g. "by providing your phone number") is used anywhere on this form.
Required Consent Language
The following consent text must appear next to an UNCHECKEDcheckbox on every opt-in form. The customer must affirmatively tick the box before the form can be submitted — pre-selection and “by providing your phone number” implied-consent language are NOT permitted (TCPA requires express consent):
“I agree to receive customer feedback survey text messages from my service provider via BrandAmplifi. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. Consent is not a condition of purchase.”
What Messages You Will Receive
After opting in, you may receive the following types of SMS messages:
- Customer feedback survey invitations with a link to a short online survey
- Follow-up reminders if you have not yet completed the survey (up to 3 messages per interaction)
How to Opt Out
You can opt out at any time by replying STOP to any message. You will receive a confirmation message and no further messages will be sent. To re-subscribe, reply START.
